RV Surge™ – Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms” or “Agreement”) govern your use of RV Surge™ websites, software, tools, training, and services (“Services”).
By accessing or using any RV Surge™ Service, you confirm that you have read, understand, and agree to be bound by these Terms.

If you do not agree, you must discontinue use immediately.

We may update these Terms at any time. Updated versions will be posted at https://rvsurge.com/legal/terms.
Your continued use constitutes acceptance.

You must be at least 18 years old to use the Services.

2. Restrictions on Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You may not:
• Reproduce, distribute, or exploit our content without permission
• Reverse-engineer our software
• Use the Services for illegal, harmful, or fraudulent activities
• Scrape, crawl, automate, or extract data
• Attempt unauthorized access
• Frame, mirror, or deep-link without permission

We may restrict or terminate access for violations.

3. Proprietary Content

All content belongs to Local Lead Hub LLC or its licensors.
No ownership is transferred.
You may make one personal, non-commercial copy.

4. Submissions

Any feedback or suggestions (“Submissions”) become non-confidential property of Local Lead Hub LLC.
You grant us a perpetual, worldwide, royalty-free license to use them for any lawful purpose.

5. Disclaimer

The Services are provided “as is” and “as available.”

We do not guarantee:
• Uninterrupted service
• Error-free operation
• Correction of defects
• Accuracy of information
• Protection from harmful code

You assume all responsibility for use.

6. Limitation of Liability

We are not liable for indirect, incidental, special, punitive, or consequential damages.

Total liability is limited to $100 or the amount you paid, whichever is greater.

7. Indemnification

You agree to indemnify and hold Local Lead Hub LLC harmless from claims arising from your use of the Services or your violation of these Terms.

8. Trademarks

RV Surge™, Local Lead Hub™, and MyHub 360™ are trademarks of Local Lead Hub LLC.
You may not use them without permission.

9. User Conduct

You may not upload or transmit content that is illegal, harmful, defamatory, obscene, fraudulent, or violates IP or privacy rights.
We may remove inappropriate content and notify authorities if needed.

10. Security

You are responsible for securing your login credentials.
You may not share accounts, attempt unauthorized access, or compromise platform security.

Suspicious activity may result in suspension.

11. Payment Terms

By subscribing or purchasing Services, you agree to pay all fees.

• Monthly or annual billing
• Payments are non-refundable
• Failed payments may suspend access
• You authorize recurring charges until cancelled

11.1 Usage-Based Billing

Usage-based fees include telephony, SMS/MMS, carrier fees, email sending, AI usage, WhatsApp fees, international surcharges, and marketplace add-ons.
All usage fees are automatically billed and non-refundable.

11.2 Missed / Late Tech Call #1 Fee

A $150 fee applies if you no-show, arrive late, or reschedule with less than 8 hours’ notice.
No fee if our team is responsible.

11.3 No Guarantee of Results

We do not guarantee leads, lead quality, cost per lead, sales, revenue, or outcomes.

11.4 Your Responsibility for Lead Response

You are responsible for responding to leads, managing notifications, and maintaining accurate contact information.

We are not liable for missed opportunities.

11.5 Advertising Performance Disclaimer

Ad performance is not guaranteed.
Costs may fluctuate.
Platforms may have outages.

11.6 Chargeback Policy

You agree not to initiate chargebacks.

If you do:
• Your account may be suspended
• A $50 administrative fee may apply
• All outstanding balances must be cleared

11.7 Data Ownership, Domains, and Transfers

You own your leads and data.

Domains purchased or hosted in RV Surge™ can only be transferred first to Cloudflare.

Websites built inside RV Surge™ / MyHub 360 cannot be transferred or exported to other platforms.

11.8 Cancellation Policy

30 days’ advance notice is required.
No prorated refunds.
Plan remains active until the end of the final paid period.

11.9 Fair Use Policy

You may not send spam, abuse AI, mass import contacts, or use the platform for non-RV businesses without approval.

11.10 Third-Party Integrations

We integrate with external platforms like Google, Meta, Stripe, and Jobber.
We are not responsible for outages, API changes, or pricing changes.

12. Software License

Your account is licensed, not sold.
You may not resell, share, or sublicense access.
Features may change without notice.

13. User Content Ownership

You retain ownership of content you upload.
You grant us a license to use it to operate the platform and comply with legal requests.

14. Testimonial & Earnings Disclaimer

Testimonials do not guarantee results.
We make no earnings claims.

15. Termination

We may terminate access for non-payment, abuse, fraud, or violations.

Payment, IP, and liability terms survive termination.

16. Privacy

Privacy practices are governed by https://rvsurge.com/legal/privacy-policy.

17. Governing Law

These Terms are governed by Texas law.

19. Force Majeure

We are not liable for delays caused by events beyond our control.

20. Severability & Waiver

If any part is invalid, the rest remains in effect.
Failure to enforce rights does not waive them.

21. Entire Agreement

These Terms constitute the full agreement between you and Local Lead Hub LLC.

22. Advertising Services Terms & Disclosures

These Ad Terms apply to subscribers who activate paid advertising.
Advertising is optional.

RV Surge™ uses a hybrid ad-management model. We create initial campaigns, configure structures, adjust when needed, and maintain alignment with your service offerings. This is not full-service ad management. Weekly calls, monthly reviews, ongoing custom builds, concierge services, custom creative strategy, and full reporting are not included. Full agency service begins at $1,000+ per month.

A 10% management fee is deducted from your ad credits automatically. Example: A $500 credit becomes $450 ad spend + $50 fee.

No agency can guarantee lead volume, quality, cost per lead, conversions, or performance timelines. Results vary by budget, competition, seasonality, location, and algorithm behavior.

Budget guidance: Under $50/day usually performs better on Meta. Over $50/day typically performs better on Google. Recommendations are not guarantees.

Google Ads require a 2–3 week learning phase and are not recommended for locations where you stay less than 6 weeks.

You must provide accurate location information and notify us of travel plans 2–4 weeks ahead. Failure to update location may cause wasted spend or performance issues.

You are responsible for responding to leads quickly, maintaining accurate information, and having sufficient budget.

By enabling ads, you authorize RV Surge™ to manage, optimize, allocate credits, pause, or modify campaigns as needed.

RV Surge™ is not liable for platform outages, policy changes, algorithm shifts, account restrictions, or market-wide fluctuations.
